1. General Provisions
1.1. These Terms of Service (the “Terms”) govern the use of the VEXND online service (the “Service”), provided by the Administration.
1.2. By accessing, registering for, purchasing, or using the Service in any way, the User confirms that they have read, understood, and accepted these Terms in full.
1.3. If the User does not agree with these Terms, they must immediately stop using the Service.
2. Nature of the Service
2.1. The Service provides a digital, intangible service in the form of access to VPN infrastructure for routing and securing the User’s internet connection.
2.2. The Service is provided on a subscription basis and is considered delivered once access credentials, configuration data, subscription link, or connection parameters have been made available to the User.
2.3. No physical goods are delivered.
3. Eligibility and User Responsibility
3.1. The User is solely responsible for ensuring that their use of the Service is lawful in their jurisdiction and complies with all applicable laws, regulations, and third-party rules.
3.2. The User is solely responsible for how they use the Service and for any consequences arising from such use.
4. Service Availability and Disclaimer
4.1. The Service is provided on an “AS IS” and “AS AVAILABLE” basis.
4.2. The Administration does not guarantee uninterrupted, error-free, or always-available operation of the Service.
4.3. Temporary interruptions, degraded performance, routing issues, restrictions by third parties, or service limitations may occur for technical, operational, or external reasons.
4.4. The Administration does not guarantee that the Service will meet the User’s specific expectations, use cases, or compatibility requirements.
5. Limitation of Liability
5.1. To the maximum extent permitted by applicable law, the Administration shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, loss of data, service interruptions, business losses, or reputational harm arising out of or related to the use of or inability to use the Service.
5.2. The User uses the Service at their own discretion and risk.
6. Acceptable Use
6.1. The Service is not intended to encourage, facilitate, or support unlawful activity.
6.2. The User agrees not to use the Service for any abusive, unlawful, or prohibited activity, including but not limited to:
- spam, unsolicited bulk messaging, or email abuse;
- DDoS attacks, port scanning, intrusion attempts, exploitation, or unauthorized access attempts;
- fraud, phishing, malware distribution, botnet activity, or payment abuse;
- distribution or access of illegal content, including child sexual abuse material or other prohibited material;
- copyright infringement or other violations of third-party rights;
- resale, account sharing, or unauthorized redistribution of the Service, unless expressly permitted by the Administration.
6.3. The User remains fully responsible for all activity performed through their account or access credentials.
7. Suspension and Termination
7.1. The Administration may suspend, restrict, or permanently terminate access to the Service, with or without prior notice, if the User violates these Terms, engages in abuse, creates risk for the Service, payment providers, infrastructure providers, or third parties, or if required by law or compliance obligations.
7.2. In cases involving abuse, fraud, prohibited use, or chargeback abuse, access may be terminated immediately without refund.
7.3. The Administration reserves the right to refuse service to any User where continued service would create operational, legal, payment, or reputational risk.
8. Payments
8.1. Payments are processed via third-party payment providers. Payment conditions are displayed to the User before completing the transaction.
8.2. The User is responsible for ensuring the accuracy of the payment details and the legitimacy of the payment method used.
9. Refunds
9.1. Refunds are governed by the separate Refund Policy published on the website.
9.2. By using the Service, the User acknowledges that digital access may be considered delivered immediately once access has been issued.
10. Changes to the Service and Terms
10.1. The Administration may modify, suspend, discontinue, or update any part of the Service at any time without prior notice.
10.2. The Administration may update these Terms at any time by publishing a revised version on this page.
10.3. Continued use of the Service after such changes constitutes acceptance of the updated Terms.
